Terms & Conditions

These terms govern your use of this website and the purchase of any content, website-design or related services from Luxwanderstay (“Luxwanderstay”, “we”, “us”, “the Studio”). You are contracting with Luxwanderstay when you engage our services.

1. Acceptance of terms

By using this website, submitting an enquiry, or purchasing a package or service from us, you agree to be bound by these terms. If you do not agree, please do not use the site or place an order. You confirm that you are at least 18 years old and, where acting for a business, that you have authority to bind that business.

2. The services

We provide photography, film, short-form content and website-design services for accommodation businesses. The specific scope, deliverables, timelines and revisions for each engagement are set out in your proposal or order confirmation, which forms part of these terms.

3. Payments & Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service enquiries relating to billing and handles returns. This means that when you buy from us:

• Paddle takes the payment, issues the receipt or invoice, and appears on your bank or card statement.
• Paddle calculates, collects and remits any applicable sales taxes or VAT.
• Billing enquiries, chargebacks and refund processing are handled by Paddle on our behalf.
• Product delivery, project scope, creative work and support relating to our services remain the responsibility of Luxwanderstay.

Paddle’s buyer terms are available at paddle.com/legal/checkout-buyer-terms and apply to the checkout in addition to these terms.

4. Prices, orders & deposits

Prices displayed on the website are starting-from guides and final quotations depend on scope, travel, integrations and complexity, as confirmed in your proposal. A booking fee or deposit may be required to secure production dates. Full payment terms and schedules are confirmed at checkout or in your proposal.

5. Refunds & cancellations

Refund entitlements, cancellation and rescheduling terms are set out in our Refund Policy. Refunds are processed by Paddle as Merchant of Record.

6. Deliverables & licence

The Studio will deliver the agreed assets within the timeline set out in your proposal. Upon full payment, you receive a non-exclusive, non-transferable licence to use the delivered content across your listings, website and social channels on the terms confirmed in your proposal. Resale or sublicensing to third parties requires our prior written consent.

7. Intellectual property

All rights, title and interest in our website, brand, templates, source files, working files, methodologies and unlicensed creative work remain the exclusive property of Luxwanderstay. Nothing in these terms transfers ownership of our intellectual property to you beyond the specific licence granted in your proposal.

8. Acceptable use

You agree not to misuse the website or our services. In particular, you must not:

• use the site or services for any unlawful, fraudulent or deceptive purpose;
• infringe our or any third party’s intellectual property, privacy or other rights;
• upload malware, attempt to gain unauthorised access, probe, scan or scrape the site, or interfere with its security or availability;
• resell, sublicense or redistribute our deliverables or website except as permitted by your licence;
• submit inaccurate billing or identity information at checkout.

9. Your content and property access

Where you provide brand assets, copy, images, property access, credentials or third-party account access to enable us to deliver a project, you grant us a limited licence to use them solely for that purpose, and you confirm you have the rights to do so.

10. Suspension & termination

We may suspend or terminate your access to the site or services, and cancel any order, if you materially breach these terms, fail to pay amounts due, use the services fraudulently or in a way that creates security, legal or reputational risk, or repeatedly violate our policies. On termination, any licences granted to you end, subject to work already fully paid for.

11. Warranties & performance

We provide the services with reasonable skill and care. We make no guarantee that use of the deliverables will produce any particular level of bookings, revenue, occupancy or search-engine ranking. To the fullest extent permitted by law, we disclaim all implied warranties.

12. Liability

Our aggregate liability arising out of or in connection with your use of the site or the services is limited to the total fees paid by you to Luxwanderstay in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, consequential or special losses, including loss of profits, revenue, data or goodwill. Nothing in these terms limits liability that cannot be limited by law (including for fraud or death or personal injury caused by negligence).

13. Governing law

These terms are governed by the laws of England & Wales and the courts of England & Wales have exclusive jurisdiction, unless otherwise agreed in writing.

14. Changes to these terms

We may update these terms from time to time. The version in force is the one published on this page on the date you place your order.
